The objective of the article is to examine the human rights enforcement in Indonesian legal and political system. This is done by studying the legal basis of human rights, the process of proliferation of human rights discourse, and the actual controversies of human rights enforcement. The study has the effect of highlighting some of the immense deficits in ensuring that violations are treated under judicial procedure and the protection of human rights is available and accessible for victims. The author inevitably (...) came into a conclusion that the openness of legal and political arenas for human rights discourses is not followed with a tangible impact on the entitlement positions of the people. The problems of the weak institutions and the unenthusiastic enforcement show that, in Indonesia, human rights are formally adopted as a political strategy to avoid substantial implementation. The norms and ideals of human rights are increasingly invoked by civil society organisations to construct claims related to land tenure and access to food, particularly to challenge a massive expansion of agricultural investment in a developing country. While this has facilitated negotiations on rights and the formulation of claims, studies that investigate to what extent such endeavours achieve the transformational goals advocated by human rights proponents or in particular whether they have been successful in instigating any institutional reform in (...) the governance of massive agricultural modernisation projects are scanty. After discussing a national agricultural modernisation project, the Merauke Integrated Food and Energy Estate , set up in Merauke, Papua, the article concludes that the analysis of the transformative role of human rights requires a prudent examination of the role of the State in the negotiation process, the patterns of socio-cultural interactions signifying the political setting and the pressure experienced and perceived by actors that affect the issues selected and omitted. This study presents findings from an ontological and contextual determination of the concept of dignity. The study had a caritative and caring science perspective and a hermeneutical design. The aim of this study was to increase caring science knowledge of dignity and to gain a determination of dignity as a concept. Eriksson’s model for conceptual determination is made up of five part-studies. The ontological and contextual determination indicates that dignity can be understood as absolute dignity, the spiritual dimension characterized by (...) responsibility, freedom, duty, and service, and relative dignity, characterized by the bodily, external aesthetic dimension and the psychical, inner ethical dimension. Many social situations require a mental model of the knowledge, beliefs, goals, and intentions of others: a Theory of Mind (ToM). If a person can reason about other people’s beliefs about his own beliefs or intentions, he is demonstrating second-order ToM reasoning. A standard task to test second-order ToM reasoning is the second-order false belief task. A different approach to investigating ToM reasoning is through its application in a strategic game. Another task that is believed to involve the application of (...) second-order ToM is the comprehension of sentences that the hearer can only understand by considering the speaker’s alternatives. In this study we tested 40 children between 8 and 10 years old and 27 adult controls on (adaptations of) the three tasks mentioned above: the false belief task, a strategic game, and a sentence comprehension task. The results show interesting differences between adults and children, between the three tasks, and between this study and previous research. (shrink)

Studies on age-related differences in risk perception in a real-world situation, such as the recent COVID-19 outbreak, showed that the risk perception of getting COVID-19 tends to decrease as age increases. This finding raised the question on what factors could explain risk perception in older adults. The present study examined age-related differences in risk perception in the early stages of COVID-19 lockdown, analyzing variables that can explain the differences in perception of risk at different ages. A total of 1,765 adults (...) aged between 18 and 87 years old completed an online survey assessing perceived risk severity and risk vulnerability of getting COVID-19, sociodemographic status, emotional state, experience relating to COVID-19, and physical health status. Results showed that the older the participants, the lower the perceived vulnerability to getting COVID-19, but the higher the perceived severity. Different predictors explain the perception of risk severity and vulnerability at different ages. Overall, self-reported anxiety over the pandemic is a crucial predictor in explaining risk perceptions in all age groups. Theoretical and practical implications of the empirical findings are discussed. (shrink)

El Foro Global de Bioética en Investigación (GFBR por sus siglas en inglés) se reunió el 3 y 4 de noviembre en Buenos Aires, Argentina, con el objetivo de discutir la ética de la investigación con mujeres embarazadas. El GFBR es una plataforma mundial que congrega a actores clave con el objetivo de promover la investigación realizada de manera ética, fortalecer la ética de la investigación en salud, particularmente en países de ingresos bajos y medios, y promover colaboración entre países (...) del norte y del sur.a Los participantes en el GFBR provenientes de Latinoamérica incluyeron a eticistas, investigadores, miembros de comités de ética y representantes de autoridades sanitarias provenientes de Argentina, Brasil, Chile, Colombia, Ecuador, El Salvador, Guatemala, Honduras, Panamá, Perú, Nicaragua y la República Dominicana. Una legítima preocupación por la protección de las mujeres embarazadas y sus embriones o fetos ha llevado a la mayoría de los países de la Región de las Américas a limitar la realización de estudios con mujeres embarazadas exclusivamente a aquellos estudios específicos sobre el embarazo, y a requerir la exclusión sistemática de las mujeres embarazadas o de las mujeres que quedan embarazadas en el curso del estudio. Ciertamente, a lo largo de la historia de la ética de la investigación, se ha creído erróneamente que proteger a una población es sinónimo de excluirla de los estudios. Se sabe ahora que proceder así implica exponer a riesgos mucho mayores a la población que se busca proteger. El embarazo implica cambios fisiológicos sustantivos e impacta profundamente la manera como el cuerpo metaboliza los medicamentos. Sin embargo, por evitar hacer investigación con mujeres embarazadas, no se ha producido la evidencia científica necesaria para tomar decisiones sobre tratamientos e intervenciones preventivas con dosis eficaces y seguras para ellas y sus embriones o fetos. A manera de ilustración, en el 2001 había en los Estados Unidos apenas más de una docena de medicamentos aprobados para uso en el embarazo (1) y en el 2011 la Food and Drug Administration (FDA) aprobó por primera vez en 15 años un medicamento para su uso en el embarazo (2). Como consecuencia de no haber producido la evidencia necesaria, se pone en riesgo la salud de las mujeres embarazadas cada vez que se les da atención médica. Las mujeres embarazadas se enferman y las mujeres enfermas se embarazan, y no se sabe si los medicamentos que se les da son eficaces o siquiera seguros para ellas y sus embriones o fetos. (shrink)

At the dawn of the twenty-first century, neurophilosophy appears as a branch of neurosciences. The aim of this article is to review critically some of the epistemological and anthropological debates which neurophilosophy is putting on question again. In this sense the philosophical research conducted by the UNESCO Chair of Philosophy for Peace will be used as the main thread of the analysis. To accomplish this critical review, the article has been organized into two parts: the first is of epistemological nature, (...) and the second has an anthropological perspective. BackgroundContradictory evidence exists about the emotional burden of participating in qualitative research for palliative care patients and carers and this raises questions about whether this type of research is ethically justified in a vulnerable population. This study aimed to investigate palliative care patients' and carers' perceptions of the benefits and problems associated with open interviews and to understand what causes distress and what is helpful about participation in a research interview.MethodsA descriptive qualitative study. The data were collected in the context (...) of two studies exploring the experiences of care of palliative care patients and carers. The interviews ended with questions about patients' and carers' thoughts on participating in the studies and whether this had been a distressing or helpful event. We used a qualitative descriptive analysis strategy generated from the interviews and the observational and interactional data obtained in the course of the study.ResultsThe interviews were considered helpful: sharing problems was therapeutic and being able to contribute to research was empowering. However, thinking about the future was reported to be the most challenging. Consent forms were sometimes read with apprehension and being physically unable to sign was experienced as upsetting. Interviewing patients and carers separately was sometimes difficult and not always possible.ConclusionThe open interview enables the perspectives of patients and carers to be heard, unfettered from the structure of closed questions. It also enables those patients or carers to take part who would be unable to participate in other study designs. The context is at least as important as the format of the research interview taking into account the relational circumstances with carers and appropriate ways of obtaining informed consent. Retrospective consent could be a solution to enhancing participants control over the interview. (shrink)

This paper examines a patient with borderline mental capacity, where the healthcare team is conflicted about how to proceed. This case demonstrates the complicated intersection between undue influence and mental capacity, allowing us to explore how the law is applied in clinical practice. Patients have the right to decline or accept medical treatments offered to them. In Singapore, family members perceive a right to be involved in the decision-making process for sick and elderly patients. Elderly patients, dependent on mainly family (...) members for care and support, sometimes submit to their overbearing influence resulting in decisions that fail to protect the patients’ own best interests. However, the clinicians’ own well-intentioned influence, driven by a desire for the best medical outcome can also be undue, and neither influence should seek to be a substitution for the patient’s decision. Following Re BKR [2015] SGCA 26, we are now obliged to examine how mental capacity can be affected by undue influence. A lack of capacity can be found when a patient fails to appreciate the presence of undue influence or is susceptible to undue influence due to their mental impairment causing their will to be overborne. This then paves the way for the health care team to decide based on best interests, because the patient is determined to be lacking in mental capacity. (shrink)

Progressive supranuclear palsy is a movement disorder with prominent tau neuropathology. Brain diseases with abnormal tau deposits are called tauopathies, the most common of which is Alzheimer's disease. Environmental causes of tauopathies include repetitive head trauma associated with some sports. To identify common genetic variation contributing to risk for tauopathies, we carried out a genome-wide association study of 1,114 individuals with PSP and 3,247 controls followed by a second stage in which we genotyped 1,051 cases and 3,560 controls for the (...) stage 1 SNPs that yielded P ≤ 10-3. We found significant previously unidentified signals associated with PSP risk at STX6, EIF2AK3 and MOBP. We confirmed two independent variants in MAPT affecting risk for PSP, one of which influences MAPT brain expression. The genes implicated encode proteins for vesicle-membrane fusion at the Golgi-endosomal interface, for the endoplasmic reticulum unfolded protein response and for a myelin structural component. © 2011 Nature America, Inc. Los avances científico-tecnológicos han abierto una brecha en cuanto a los tratamientos médicos y los valores morales que deben sustentar la atención de salud. El profesional de enfermería no está exento de estos peligros, por lo que se ha generado un nuevo modelo ético que se integre al proceso de atención de enfermería. Con el objetivo de determinar los conocimientos y opiniones de estos profesionales, del área de cirugía de mínimo acceso, acerca de la aplicación del modelo en el contexto (...) de estos servicios, se diseñó una investigación de tipo observacional descriptiva con empleo de metodología cualitativa. Como técnica de exploración se usó la entrevista en profundidad, así como un panel de expertos para la construcción de la guía de entrevista. Se entrevistó a 34 enfermeras que laboraban en el Centro Nacional de Cirugía de Mínimo Acceso durante el período del estudio. Se concluye que la práctica de la cirugía de mínimo acceso es propicia para que médicos y enfermeras hagan una mayor observancia del derecho de autonomía de los pacientes. Se reconoce la capacidad de este personal para tomar decisiones independientes de los médicos en cuanto a las acciones de cuidado, lo que implica una mayor responsabilidad. Scientific and technological advances have opened a gap between medical treatments and the moral values that should support health care. The nurse is not exempt from these dangers. As such, a new ethical model that integrates to the process of nursing care has emerged. In order to determine the knowledge and opinions of the professionals who work in minimal access surgery services on the implementation of this model, a descriptive, observational study was designed utilizing qualitative methodology. In-depth interviewing was used as the primary testing technique. A panel of experts from the National Center of Minimal Access Surgery was consulted to develop the interview guide. Thirty-four nurses from the National Center for Minimal Access Surgery were interviewed over the course of the study period. Results suggest that the setting of minimal access surgery is conducive to medical professionals making greater observance of the right to patient autonomy. The ability of this staff to make independent decisions regarding medical care action is recognized, which implies greater responsibility. (shrink)

Small GTPases in the Rho family act as major nodes with functions beyond cytoskeletal rearrangements shaping the Caenorhabditis elegans embryo during development. These small GTPases are key signal transducers that integrate diverse developmental signals to produce a coordinated response in the cell. In C. elegans, the best studied members of these highly conserved Rho family small GTPases, RHO‐1/RhoA, CED‐10/Rac, and CDC‐42, are crucial in several cellular processes dealing with cytoskeletal reorganization. Known throughout East Asia as Mengzi, or "Master Meng," Mencius was a Chinese philosopher of the late Zhou dynasty, an instrumental figure in the spread of the Confucian tradition, and a brilliant illuminator of its ideas. Mencius was active during the Warring States Period, in which competing powers sought to control the declining Zhou empire. Like Confucius, Mencius journeyed to one feudal court after another, searching for a proper lord who could put his teachings into practice. Only a leader who (...) possessed the moral qualities of a true king could unify China, Mencius believed, and in his defense of Zhou rule and Confucian philosophy, he developed an innovative and highly nuanced approach to understanding politics, self-cultivation, and human nature, profoundly influencing the course of Confucian thought and East Asian culture. _Mencius_ is a record of the philosopher's conversations with warring lords, disciples, and adversaries of the Way, as well as a collection of pronouncements on government, human nature, and a variety of other philosophical and political subjects. Mencius is largely concerned with the motivations of human actors and their capacity for mutual respect. He builds on the Confucian idea of _ren_, or humaneness, and places it alongside the complementary principle of _yi_, or rightness, advancing a complex notion of what is right for certain individuals as they perform distinct roles in specific situations. In the framework of the history approach to quantum mechanics and, in particular, of the formulation of Gell-Mann and Hartle, the question of the existence of inequivalent decoherent sets of histories is reconsidered. A simple but acceptably realistic model of the dynamics of the universe is proposed and a particular set of histories is shown to be decoherent. By suitable tranformations of this set, a family of sets of histories is then generated, such that the sets, first, are decoherent on (...) the basis of the assumed dynamics of the universe and, secondly, arc certainly inequivalent, apart from trivial special cases. Finally, the original set of histories is refined to get a model of the usual quasiclassical domain and it is shown that, applying to it the previously considered transformations, a family of sets of histories is obtained which share typical properties of the usual quasiclassical domain. The favored economic position that Venice enjoyed in the eastern Mediterranean and the Black Sea following the Fourth Crusade lasted only until the fall of the Latin Empire of Constantinople in 1261. During the next century the republic sought to reinstate its hegemony over the waterways and engaged in a prolonged struggle for maritime supremacy with its Ligurian rival, Genoa. The two cities were unable to resolve their debates over commercial privileges in key ports until 1381, following the conclusion of (...) the War of Chioggia. One of the features of this contest was a sharp rise in the instances of piracy and warfare between corsairs, particularly along the critical routes of Levantine trade. Genoa, however, was not the only power to challenge Venetian trade and domination. Robbery on the seas increased markedly as new adversaries edged their way onto the naval stage with greater intensity after 1300. The fourteenth century may have been a watershed in the history of naval plundering, marking a transitional phase during which the difference between pirates and corsairs crystallized. Moreover the years preceding the War of Chioggia reveal how Venice responded to the growing instability, how the commune implemented measures to deal effectively with multiplying threats, and, above all, how the republic's naval affairs reflected both remarkable elasticity and cohesion within the scope of state policies. Crisis and the Revolutionary Moment : Marx and 1848 How are we to assess the role played by the 1848 revolution in the evolution of Marx’s thought ?The hypothesis developed here is that the 1848 revolution helped to fill in a “theoretical gap” and toresolve what was a conceptual inconsistency in the Marxian theory of the 1840s. The revolutionarymoment thus contributed to the formulation of a consistent theory of revolution. Marx’s analysis ledto the formulation of two new theoretical principles : (...) that of the link between economic crisis andrevolution, and the concept of “the intensity of the crisis”. This consolidated his analysis of the relation between the cyclical crises of capitalism and the revolutionary moment. The article begins withan attempt to specify the nature of these Marxian theoretical principles. It goes on to examine theprecise implications of the new coherence of the Marxian revolutionary theory. In conclusion, by wayof a confrontation with Althusser’s conception of the revolutionary moment, the article seeks to spellout the theoretical and political implications of this “new theory of the revolutionary moment”. This article presents the relationship between the notions of equality and freedom assumed by Castoriadis as necessary conditions for social autonomy project. The chiasmatic figure that Castoriadis establishes between equality and freedom will be approached with the aim of clarifying whether both notions should be addressed jointly or, on the contrary, they can be considered separately for an autonomy project as well. Once exposed the difficulties that appear in the representation that establishes a correspondence between both terms, attention will be (...) directed to the need of the figure of law as a legal element to guarantee the privileges that are granted to the members of the community in the Autonomy project that is equal participation. To conclude, the article will be directed to a silence in the work of Castoriadis; who can be considered a subject in the autonomy project, that is, who should participate in the formation of the new institutions. The aim of this volume is to critically assess the philosophical importance of phenomenology as a method for studying the normativity of meaning and its transcendental conditions. Using the pioneering work of Steven Crowell as a springboard, phenomenologists from all over the world examine the promise of phenomenology for illuminating long-standing problems in epistemology, the philosophy of mind, action theory, the philosophy of religion, and moral psychology. The concept of interpersonal emotion regulation refers to a variety of processes in which emotion regulation occurs as part of live social interactions and includes, among others, also those interpersonal interactions in which individuals turn to others to be helped or to help the others in managing emotions. Although IER may be a concept of interest in group therapy, specific theoretical insights in this field appear to be missed. In this article, we firstly provide a review of IER definitions, of (...) classifications of IER strategies, and of IER clinical conceptualizations. Afterwards, we discuss the relevance of considering IER for group therapy, both in terms of non-specific group therapeutic factors and of group therapy techniques promoting adaptive emotion regulation, underlining the potentially relevant role of IER behaviors as intrinsically involved in group experience. This study examines the relationships between a company''s emphasis on discretionary social responsibility, environment, and firm performance. It tests the proposition that environmental munificence and dynamism moderate the relationship between discretionary social responsibility and financial performance. Social responsibility was measured with a three-item scale in a sample of 62 firms using a questionnaire. Environmental munificence and dynamism were measured using archival sources as was financial performance (return on assets and return on sales). The results of moderated regression analyses and subgroup (...) analyses found a significant moderating effect of environment on the social responsibility-firm performance relationship. Discretionary social responsibility contributes to firm performance in environments that are dynamic and munificent. (shrink)

This article adds to the conversation analytic literature on repair and on preference structure by examining a previously-undescribed otherinitiated repair practice, using the form of an alternative question, and the various actions that this practice is used to accomplish. Alternative question repair initiations can present alternate hearings or understandings of a prior utterance for clarification. They can also be used to initiate error correction by targeting a trouble source in a prior utterance with the first alternative and providing a candidate (...) correction with the second. In the latter case, rejection of the candidate preference can be done as a dispreferred response. Recipients can make use of both turn design and context to interpret the actions being done through this form of repair. (shrink)
